Judge Lisa Lenihan and her team offer a diverse range of services, including mediation, early neutral evaluation, special master, and arbitration. With a focus on prompt, effective, and confidential resolution, they are dedicated to achieving the best results for all parties.
Judge Lenihan is a skilled mediator who has litigated, presided over and mediated
a wide range of disputes, ranging from complex class action cases to personal injury and employment cases. Her style is a combination of facilitative and evaluative, tailored to the case and the needs of the parties.
All mediation services will be charged at a rate of $700 per hour. There is a 4 hour minimum charge of $2,800 for a half day session and $5,600 for an 8 hour full day session. Any additional hours will be billed at the hourly rate quoted.
Early neutral evaluation is a non-adjudicative process in which Judge Lenihan will provide a non-binding evaluation of the case, following review of materials and presentations of the parties. Her 40 years of legal experience, both on and off the bench, give her the expertise to effectively evaluate cases. If desired, she is also available to assist parties in reaching a settlement agreement.
Fees for Early Neutral Evaluation are the same as those for mediation.
Judge Lenihan can act as a special master to resolve discovery disputes. As a litigation attorney for the first two decades of her legal career, she was involved in the intricacies of discovery from the perspective of the parties and the attorneys. She handled hundreds of discovery disputes between parties while a Federal Magistrate Judge and is well-equipped to assist the parties in reaching a resolution of these matters.
Billing for these services would be at the rate of $700 per hour. There may also be additional administrative charges.
* Any legal research or required opinions would be billed additionally at a rate of $250 per hour for her legal assistant.
Judge Lenihan will serve as a single or on a panel of three arbitrators for a binding or non-
binding arbitration.
There is flat rate of $7,500 per day for the Arbitration hearing. Fees for Judge Lenihan’s time spent on all other services before and after the Arbitration are calculated based upon an hourly rate of $700. A statement will be provided after the conclusion of the Arbitration. A retainer of $4,000 per party is due upon confirmation of the hearing date.
If an opinion is requested, the time for researching and drafting said opinion will be billed additionally at a rate of $250 per hour for her legal assistant.
Disclosure
Judge Lenihan is a member of the Board of Directors of the UPMC Health Plan as well as UPMC Passavant and St. Margaret’s. As mediation is a non-adjudication process, she is available to mediate cases involving these entities and can be impartial. However, she wanted you to be aware of this affiliation when making your choice of her as a neutral.
